Selling iPhone without charger, Apple is sued
Apple said in 2020 that it would eliminate the charger and headphones from the iPhone packaging. The company claims that by using smaller containers, it will be able to cut its carbon emissions by 2 million tons per year. This amount of pollution is equivalent to 450,000 automobiles on the road.
However, this move has sparked considerable debate among users and authorities in a number of nations. Notably, a Brazilian court recently ordered Apple to reimburse a consumer $1,075 for failing to sell an iPhone with a charger. This, according to the government, is a breach of the country’s consumer protection regulations.
“Article 39 of Brazil’s consumer protection code (CDC) bans pressuring people to purchase another product without selling the one they are already using. We do not let the corporation to sell the phone and charger separately. As a result, Apple will be sued in the city of Goiania for selling iPhones without a charger,” the lawsuit claims.
According to MacRumors, this is not the company’s first run-in with Brazilian law. The country was penalized $2 million last year for breaking and disrespecting consumer protection regulations, according to Fernando Capez, head of consumer protection agency Procon-SP.
Procon specifically questioned Apple’s decision not to include a charger and wired headphones with the iPhone 12. Following that, the agency found that “Apple has not demonstrated ‘environmental protection’ benefits, such as those they promote,” and also announced a $2 million USD fine for the company’s behavior.
On the other side, this case may indicate that Brazil is on the verge of requiring Apple to include chargers in iPhone boxes sold in the nation. Additionally, Procon-SP feels that the charger plays a critical role in the user’s smartphone experience.
Apple will breach Brazilian consumer law if the charger is not supplied. Apple responded by stating that many users already own chargers and that eliminating the charger will help safeguard the environment by lowering the iPhone’s greenhouse gas emissions.
According to Android Authority, Samsung was forced to sell smartphones with chargers in the Brazilian market despite its policy of deleting chargers. Additionally, Apple includes a charger and headphones in France, as the country’s law requires Apple to sell iPhones with these two devices.
Previously, in October 2021, a group of Chinese students sued Apple over the lack of an iPhone 12 series charger. They stressed that Apple omitted a charger from the iPhone 12 series in order to enhance earnings. Profits are being made, and the firm is sheltering behind the appearance of environmental protection. According to the Daily Mail, Apple saved a total of $ 6.5 billion by deleting the device’s charger and headphones.
